Under the influence of Bentham and Utilitarianism,human rights were either regarded as ″nonsense without foundation″,or equaled to legal rights.Facing the embarrassed situation of human rights,Amartya Sen formed a human rights theory of capabilities approach. This puts human rights on a certain basis,which not only denies the claim that human rights have no foundation,but also defuses the risk that human rights were equaled to legal rights which narrow human rights.The human rights theory of capabilities approach points to the realization of human rights from the beginning. It contains a complete set of logic of human rights realization.
